In litigation, an expert witness can play a crucial role in swaying a case toward one side by sharing highly specialized knowledge as evidence. A new video series by Brian Peter Brinig, known as “the expert’s expert,” delves into every aspect of developing, managing and successfully operating a forensic expert witness practice, including important practice management considerations. The “Art of Expert Witness Testimony” video series also highlights the strategies and tactics for expert witnesses testifying in court.
Brinig is managing director of San Diego-based CBIZ Forensic Consulting Group and an adjunct professor at the University of San Diego School of Law. An attorney who is also a certified public accountant, Brinig wrote “Mastering the Art of Expert Witness Testimony,” which covers every aspect of a forensic consulting practice. Having qualified as an expert witness in more than 300 trials in federal and state courts across the United States and given sworn testimony in 600 depositions, Brinig gained valuable insights on being an expert. He shares best practices and lessons learned for running a successful expert witness practice, as well as providing effective testimony that supports fair and just judgments, settlements and verdicts.
“Competent expert witness testimony does not begin on the witness stand — it begins the minute the potential expert is contacted by a prospective client,” Brinig says. “From that moment on, the expert witness must employ important practice management techniques to support development of high-level expert witness testimony in depositions and trials.”
The video series, like the book, delves into the art of an expert witness practice, going beyond testimony techniques to the broader strategies and tactics of practice management that make an expert’s testimony defensible and able to withstand strenuous cross examination. The short videos present the essence of a competent expert witness practice regardless of the expert’s industry or profession.
The “Art of Expert Witness Testimony” includes components on billing, conflict of interest, legal privileges and other techniques for dealing with adverse lawyers in litigation. Five of the videos address the expert’s specific tactics for deposition and trial testimony and three provide tactics to attorneys on best practices for taking an expert witness’ deposition.
